Terms and Conditions

Scope of Application

1.1. These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded via the online shop at www.wartburg.eu between

(hereinafter "Seller" or "we")

and the customer (hereinafter "Customer").

1.2. The offer is aimed equally at consumers and entrepreneurs. A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity.

2. Conclusion of Contract

2.1. The presentation of goods (in particular automotive parts and accessories) in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. 2.2. By clicking the order button, you place a binding order for the goods contained in the shopping cart. 2.3. The contract is concluded when we accept your order by sending an order confirmation via e-mail immediately after receiving your order, or when we dispatch the goods to you.

3. Prices and Payment Conditions

3.1. The stated prices are total prices in Euros. Due to small business status (tax-exempt), no VAT is shown. Any applicable shipping costs are added to this and are shown separately during the ordering process. 3.2. The payment options displayed in the online shop are available to the Customer (e.g., Advance Payment/Bank Transfer, Credit Card, PayPal).
3.3. If advance payment is agreed, payment is due immediately after the conclusion of the contract. The goods will only be dispatched after receipt of payment.

4. Delivery and Retention of Title

4.1. Delivery takes place via shipping to the delivery address provided by the Customer.
4.2. Since our warehouse is located in Hungary, please note the delivery times for international shipping specified in the shop. Link to the page: [here]
4.3. The goods remain our property until the purchase price has been paid in full.
4.4. The following applies additionally to entrepreneurs: We reserve the title to the goods until all claims arising from an ongoing business relationship have been settled in full.

5. Special Features Regarding the Purchase of Automotive Parts and Accessories

5.1. Verification of Fitment: The Customer is obliged to check whether the delivered parts are suitable for the intended vehicle before assembly or installation (e.g., by comparing part numbers or visually comparing with the old part).
5.2. Installation by Qualified Personnel: We expressly point out that the installation of safety-relevant automotive parts (e.g., brakes, chassis/suspension, lighting) must be carried out professionally and in accordance with the manufacturer's specifications. We strongly recommend having the installation carried out by a specialist workshop. Damages resulting from improper installation are not covered by the warranty.
5.3. Road Traffic Approval: Unless otherwise stated in the item description, it is the Customer's responsibility to check whether the respective accessory is approved for use on public roads in the respective country (e.g., E-mark for cars from the 80s, or Type Approval).

6. Statutory Liability for Defects (Warranty)

6.1. Statutory liability rights for defects apply. 6.2. For consumers, claims for defects expire in two years for new items and in one year for used items from the delivery of the goods. 6.3. No warranty is assumed for damages resulting from:

  • Improper or incorrect assembly or commissioning by the Customer or third parties.

  • Natural wear and tear (e.g., typical wear parts such as brake pads or wiper blades), provided the defect was not already present at the time of handover.

  • Non-observance of installation and operating instructions.

7. Liability

7.1. We are liable without limitation for damages arising from injury to life, limb, or health, as well as in cases of intent and gross negligence. 7.2. In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner may regularly rely, we act liable even in cases of slight negligence, but limited to the foreseeable damage typical for the contract at the time of conclusion. 7.3. Otherwise, liability is excluded.

8. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

To exercise your right of withdrawal, you must inform us

by means of a clear declaration (e.g., a letter sent by post or an e-mail) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

9. Dispute Resolution

We are neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.

10. Final Provisions

10.1. If you are an entrepreneur, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. 10.2. The contract language is English.
